Sir John Clerk of Pennicuik To James Mitchell & his spouse
Four houses and yeard in Lasswade
28 Januarie 1709

 

 

To all and sundrie whom it effeirs wilt ye no Sir John Clerk of pennycook knight and Barronet Heritable proprietor of the lands and Barronie of Lasswade in contemplatione of the Act of parliament made annent setting out of lands in feu ferm for the increase of policy and the Decovement of this Kingdom as also tro and certain soum of money payed to me Be James Mitchell tennant of easter Melvine. Therefore to have given granted sett in feu ferm and Disponed to the said James Mitchell and Elspeth Gibson his spouse and longest liver of them two in conjunctfie and to ye airs procreate or to be procreate betwixt them which fayling to the said James Mitchell his other nearest airs or assignays whatsoever of no higher degree nor himself heritable and irredemablie all and heall these four housses with ye Kaleyard lyand at ye back thereof three elem trees and one pine tree growing therein Lyand upon the west side of the high streit of Lasswade which formerly was possessed by William Dick meallmaker William Craik litster and Janet Train all indwellers which house with ye Kaleyard is twentie seven ells on ye East side twenty nyne ells and one quarter ane ell on ye south side twentie five ells and an half on ye west and sixteen ells on ye north extending in ye whole to nyntie seven ells and threequarters. The heall circumference including ye said houses and yeard lying bounded as follows viz having on ye East ye causey or high street of Lasswade and upon ye south William Ramsays stable and ane Kaleyard which belongs to ane old house which was formerly possest by James Hall shoe maker there and upon ye west the Minister of Lasswades gaiding and barnyard dyks and upon ye north ye Kirkenyard all lying in ye Barronie village and paroch of Lasswade and sheriffdom of Edinburgh whose entire heirts is Declared to be at Whitsunday seventeen hundred and eight years Reserving fra ye said James Mitchell his spouse and the forsaids all Liberties of brewing ale strong watters or any other liquiors or of tapping and venting the samen or off taking of any watters without sufficient testificate without liberty fra ane of the said Sir John Clerk my airs or successours for these effects To be holden the said houses and yeard thereto belonging By the said James Mitchell his spouse and their forsaids of Me my airs and successours in feu ferm and heritage for ever by all rights miths and marches of the samen lyes in length and breadth and bounded in maner abovementioned with free and entire thereto and with all and sundrie other priviledges righteous pertinence thereof whatsoever any trouble lett or Impediment in all time comeing payand therefore yearly the said James Mitchell his spouse and these forsaids to me and my above written the soum of twenty shilling scots money in name of few ferm for ye said houses and yerd Beginning the first years payment of the said feu doutie at Whitsunday first to come seventeen hundred and nyne years for ye year immediately preceding and so furth yearly thereafter and doubling the said feu ferm ye first year of every entry of ane aire to the said Lands as the custom is in like caices in feu ferm and performing suit of presence in my courts within the said Barronie and to make there grindable corns growing or which shall happens to grow within ye said Barronie of Lasswade with all other grindable corns so far as lies in thoue power at my mill of Kevock and to pay the said deuties with other services used and perform are under the provisions aftermentioned That it shall not be leison to ye said James Mitchell his spouse and ye forsaids to sell annalyse and dispone the houses and yerd dyks from wind and demolishing after they are repaired by them and I the said Sir John Clerk do hereby bind and oblige me and my forsaids to warrant ye said houses and yerd and others foresaid afor disponed with this present right thereof to ye said James Mitchell his spouse and theire forsaids at all hands and against all deadly Attoure to and ilk and of your conjunctlie and my Baylies in that part specalie. Greetings It is my will and I require you that Incontinent after sight hereof you pass to the ground constitute of ye said Lands and there give heritable state and seasinie reall and corporal possession of all and heall ye forsaid houses with ye yerd Belonging thereto to lyand upon ye west side of ye causey or high streit of Lasswade and as they are above disponed all lying within the Barronie parochen and Sheriffdom forsaid and bounded mithed and marched above exprest to ye said James Mitchell and Elspeth Gibson his spouse or longest liver of them two in conjunctfie or to their certain Activity their name bearers hereof be Deliverance of earth and stone of ye grounds of ye said Lands in ye hands as use is; To be holden and under ye provisions always afore mentioned conceived in my favours and this on mae wayes leave wont to the said mill with all other services used and wont as my vassals and tenants are in use to undone. The whilk to do I commite to you and ilk and ane of you my Baylies in that part foresaid conjunctlie and seaverlie my full power be this my precept deliver it to you there annent; In witness thereof the presents (written by William Mackall schoolmaster in Lonhead of Lasswade) and subscryved by me and my seal affixed thereto att Lonhead the twenty eight day of Januarie seventeen hundred and nyne year Before these witnesses the said William Mackall and James Mackie clerk give to ye said Sir John.
